Terms of Service
These Terms of Service ("Terms") are a binding agreement between you ("Customer," "you") and Washers ("Washers," "we," "us," "our"), a mobile washing and detailing business based in Coeur d'Alene, Idaho. They govern your use of this website and any services we provide to you. By submitting a quote request, accepting a quote, scheduling a job, allowing us to begin work, or using this website, you agree to these Terms. If you do not agree, please do not use the website or request our services.
1. Eligibility and authority
You must be at least 18 years old and legally able to enter into a contract. You represent that you own the property or vehicle to be serviced, or that the owner has authorized you to request and approve the work on their behalf. You are responsible for the accuracy of the information you give us.
2. Services
We provide car detailing (exterior, interior and full details), trash can cleaning, and washing of boats, RVs, ATVs, golf carts and similar items. The scope of each job is the work described in the written or text confirmation we send you (the "Confirmation"). Anything not described in the Confirmation is not included. We may decline or stop any job that we reasonably believe is unsafe, outside our equipment or experience, or likely to cause damage.
3. Quotes, prices and changes
- Quotes are free. A quote is an offer based on the information you gave us and is not a guarantee of the final price or of availability.
- Package prices are flat rates for the scope described on our Services page. Add-ons (for example an oversize vehicle, pet hair, heavy mud or heavy buildup) apply only when your job needs them.
- If we find conditions that differ from what you described, we will tell you and agree on any change in price or scope before we do the additional work. If we cannot agree, we may complete only the original scope or stop the job.
- Prices shown on this website may change at any time and apply only to jobs confirmed after the change. Taxes, if any apply, are your responsibility.
4. Booking, scheduling, weather and cancellation
Submitting the quote form is a request, not a booking. A binding agreement for a job exists only when we send you a Confirmation and you accept it (including by allowing us to begin work). Appointment times are estimates. We may need to reschedule because of weather, equipment problems, illness, safety concerns or other circumstances outside our control, and we will let you know as early as reasonably possible. We are not liable for delays or rescheduling caused by such circumstances. Please give us reasonable notice if you need to cancel or change a time. We may cancel or decline any job at our discretion before work begins.
5. Your responsibilities
- Provide safe and reasonable access to the property, vehicle or items, including a working outdoor water spigot and a hose that reaches the work area (we currently use your hose and your water), and electrical access where the job requires it. Tell us in advance if any of that is not available.
- Tell us before we begin about anything fragile, loose, cracked, peeling, previously repaired, leaking, damaged or otherwise sensitive, including paint, sealants, seals, screens, window frames, glass, wiring, trim and aftermarket parts.
- Remove or secure valuables, loose items, furniture and personal belongings, and keep pets and children away from the work area.
- Close and lock windows, doors, sunroofs and hatches as needed, and tell us about hazards such as exposed wiring, sprinkler heads, hornets or wasps nests, and unsecured items.
- Make sure someone is available to approve changes and to make payment when the work is complete.
6. Assumption of risk and pre-existing conditions
Washing, pressure washing and detailing involve inherent risks. You understand and accept that, even when work is done with reasonable care, cleaning can reveal, worsen or cause damage to surfaces and items that are old, weathered, loose, cracked, improperly installed or already damaged. Examples include failing paint or clear coat, cracked or spalling concrete, loose pavers or joint sand, deteriorated caulk or window seals, oxidized or aftermarket finishes, screens, rubber and trim, and water entering through existing gaps or leaks. Some stains, etching, hard-water deposits, oxidation and scratches cannot be fully removed. We are not responsible for damage, defects or conditions that existed before our work, that you did not tell us about, or that result from normal wear, age or inherent risks of the work.
7. No guarantee of results
We aim to do careful, workmanlike jobs, but we do not guarantee a particular result, appearance or level of cleanliness, or that stains, odors or marks will be completely removed. Results depend on the condition, age and material of the item being cleaned. If you have a concern about completed work, you must tell us in writing (text or email, with photos where possible) within seven (7) days after the work is finished. At our sole discretion and as your sole remedy for dissatisfaction with the quality of the work, we may re-clean the affected area or refund part of the price for that area. Concerns raised after seven days, or after the work area has been altered, used or cleaned by someone else, may not be eligible for any remedy.
8. Payment
Payment is due in full when the work is completed, unless we agree otherwise in writing. We will tell you which payment methods we accept when we confirm your quote. Third-party payment providers (for example Venmo, Cash App, PayPal or Apple Pay) apply their own terms and fees. If you do not pay when due, you remain responsible for the balance, and to the extent permitted by law you agree to pay our reasonable costs of collection. Completed work is not refundable except as stated in Section 7 or as required by law.
9. Disclaimer of warranties
To the fullest extent permitted by law, our services and this website are provided "as is" and "as available," and we disclaim all warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, workmanlike performance, title and non-infringement. We do not warrant that this website will be uninterrupted, error-free or free of harmful components. Nothing on this website is a promise of any particular result.
10. Limitation of liability
To the fullest extent permitted by law, Washers, its owners, partners, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of use, loss of income, loss of value, or inconvenience, arising out of or related to our services or this website, even if we were told such damages were possible. Our total aggregate liability for all claims arising out of or related to a job or these Terms will not exceed the amount you actually paid us for that job.
These limits apply to claims of any kind, including contract, negligence and other tort claims, to the extent permitted by law. They do not limit liability that cannot be limited or waived under applicable law, such as liability for fraud, gross negligence, willful misconduct, or other matters that Idaho law does not allow to be limited. Because some jurisdictions do not allow certain limitations, some of the above may not apply to you, and in that case our liability is limited to the smallest extent the law allows.
11. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Washers and its owners, partners, employees and contractors from claims, losses, damages, liabilities and reasonable expenses (including reasonable attorney fees) arising out of: (a) inaccurate or incomplete information you give us; (b) your lack of ownership of, or authority over, the property or item; (c) hazards or conditions you knew about and did not disclose; or (d) claims by third parties relating to property or items we serviced at your request.
12. Property, access and safety
You grant us permission to enter the work area for the purpose of performing the job. We may use your water and electricity where needed and where you have given access, and we will use reasonable care when doing so. We may stop work at any time if conditions are unsafe, such as lightning, ice, aggressive animals or threatening behavior.
13. Photos and media
We may take before-and-after photos of our work. We will publish photos of your property or vehicle (on our website or social media) only with your permission, and we will not show your name or exact address. You may decline, or withdraw your permission for future use, at any time by contacting us at cdawashers@gmail.com or (208) 889-9034.
14. Communications
By giving us your phone number or email address, you agree that we may contact you by phone call, text message or email about your request, quote, scheduling and job. Message and data rates from your carrier may apply. You can ask us to stop contacting you by any of these methods at any time, although we may still need to reach you about a job already scheduled. We do not send marketing text messages without your separate agreement.
15. Use of this website
- The information on this website, including prices, descriptions, service areas and availability, is provided for general information and may contain errors or be out of date. It is not a binding offer.
- The website, its text, design, logo and graphics belong to Washers or its licensors and may not be copied, scraped or reused for commercial purposes without our written permission. You may view and share links to the website for personal, non-commercial use.
- You agree not to misuse the website, including submitting false or spam requests, attempting to disrupt it, or attempting to gain unauthorized access.
- The website uses third-party services (for example Google Fonts and Google Maps) and may link to other websites. We do not control and are not responsible for third-party services or sites. Their use is governed by their own terms and privacy policies.
16. Force majeure
We are not responsible for any failure or delay caused by events beyond our reasonable control, including severe weather, natural disasters, fire, utility or water restrictions, illness, accidents, equipment failure, government orders or supply shortages.
17. Governing law, disputes and venue
These Terms and any dispute relating to them or to our services are governed by the laws of the State of Idaho, without regard to conflict-of-laws rules. Before starting any legal action, you agree to give us written notice describing the problem and to work with us in good faith for at least thirty (30) days to resolve it. Any claim that cannot be resolved informally must be brought in the state or federal courts located in or serving Kootenai County, Idaho, and you consent to those courts' jurisdiction and venue. Either party may bring an eligible claim in small claims court. To the extent permitted by law, any claim must be filed within one (1) year after it arises, or it is permanently barred.
18. General terms
- Entire agreement. These Terms and the Confirmation are the whole agreement between you and us about the services. If they conflict, the Confirmation controls for the scope and price of the job.
- Severability. If any part of these Terms is found unenforceable, it will be enforced to the extent allowed and the rest will remain in effect.
- No waiver. If we do not enforce a provision, that is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a sale or reorganization of the business.
- Independent parties. Nothing in these Terms creates a partnership, employment or agency relationship between you and us.
- Survival. Sections that by their nature should continue after a job is finished (including Sections 6 through 11 and 17) will continue to apply.
19. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date and applies to jobs confirmed and website use after that date. Jobs already confirmed continue under the Terms in effect when they were confirmed.
